This is the time of year that many employers and employees have questions about the Tennessee laws regarding holiday pay. Under Tennessee law, an employer is not required to provide paid vacations, paid holidays, or holiday pay (such as time and a half). However, many employers choose to provide these benefits to their employees. The policies should be spelled out clearly in the employee handbook, as well as reviewed with all employees leading into the holiday season to prevent confusion.
Keep in mind however, that often employees that are working long hours during the holiday season may be over 40 hours in a week, and federal law does require time and a half for the overtime work.
